Dispute resolution information

We remind you that if you are a consumer and have submitted a complaint regarding a contract entered into with T-Data S.r.l. (“T-Data S.r.l.”) through this website, but it was not possible to resolve the dispute that was the subject of the complaint, T-Data S.r.l. will provide you with information regarding the Alternative Dispute Resolution body or bodies for the out-of-court resolution of disputes (so-called ADR bodies, as indicated in articles 141-bis et seq. of the Consumer Code), specifying whether or not it uses such bodies to resolve the dispute itself.

We also remind you that a European platform for the online resolution of consumer disputes (so-called ODR platform) has been established. The ODR platform can be accessed at the following address http://ec.europa.eu/consumers/odr/; through the ODR platform you can consult the list of ADR bodies, find the link to the website of each of them and initiate an online dispute resolution procedure in which you are involved.

According to art. 49 c. 1 letter v) of Legislative Decree no. 206/2005 (Consumer Code), customers who intend to resolve a dispute with the merchant (i.e. T-Data S.r.l.) can use the Joint Conciliation procedure. The Procedure can be initiated if, after having submitted a complaint to the company, the consumer has not received a response within 45 days, or has received a response that is not considered satisfactory by them. For any cross-border dispute relating to the application, execution and interpretation of T-Data S.r.l.'s General Terms and Conditions of Sale governing purchases made through this site, if you habitually reside or are domiciled in a European Union member state other than Italy, you may initiate the European procedure established for small claims disputes by Council Regulation (EC) No 861/2007 of 11 July 2007, before the competent court, provided that the value of the dispute does not exceed, excluding interest, rights and expenses, Euro 5,000.00 on the date on which the competent court receives the application form.

In any case, whatever the outcome of the out-of-court dispute resolution procedure, your rights to appeal to the ordinary court are reserved, and, if the conditions are met, to promote an out-of-court resolution of disputes relating to consumer relations by recourse to the procedures referred to in Part V, Title II-bis of the Consumer Code.
